  • Each parent’s lifestyle
  • Each parent’s ability to care for the child
  • Each parent’s income
  • The relationship between the child and each parent
  • The child’s current routine
  • The child’s preference, if of a certain age

After considering these factors a judge will rule to grant physical and legal custody to either one or both parents.  In cases in which only one parent is granted physical custody, the judge will usually grant visitation rights to the other parent.
